How to Read Probate Examiner Notes
After examining your petition, the Probate Examiner prepares the Probate Notes which point out deficiencies and represent her recommendations to the Court. They are NOT tentative rulings. Examiner's notes are generally available two weeks before the scheduled hearing date, and remain a part of the Register of Actions. The notes can be accessed through the Court's website: www.stocktoncourt.org.
The notes are not updated. Approximately four days prior to the date of hearing the Probate Judge will review the file, and issue his Tentative Rulings which can be accessed through the Court's website: www.stocktoncourt.org.
If law offices would like to continue a matter to cure defects shown in the Examiner's notes, they may do so by sending an email to probatexam@courts.san-joaquin.ca.us no later than 2:00 p.m. two (2) days before a hearing. The email is to state the case name and number and indicate a date to which the continuance is requested. Notice of the continuance and/or an Amended Notice of Hearing shall be sent by the moving party to all parties previously Noticed. If such an email request is timely made, no appearance is required at the hearing, and the matter will be continued unless the Tentative Ruling indicates the Court will direct otherwise.
Every case will be called in open court and the intended decision will be given unless objections are presented. Any approved matter in which there is an objection may be continued for at least two weeks for further hearing.
In order to be considered by the Examiner, all documents to cure defects must be filed at least four (4) court days prior to the date of hearing, and must include the date and time of the hearing within the caption of the document. Please be sure to inform the filing Clerk that the document is being filed to cure a defect per the Probate Examiner's notes to assure that the document is placed the appropriate file prior to the hearing.
