CASE #0502 SAN JOAQUIN COUNTY JAIL

REASON FOR INVESTIGATION:

The San Joaquin County 2002-2003 Grand Jury received a citizen complaint from a female inmate alleging physical and psychological abuse while being detained at the San Joaquin County Jail.

BACKGROUND:

The complainant alleges that a correctional officer made lewd sexual comments to her and physically abused her. The complainant also alleged that she was denied the opportunity to file a formal complaint.

METHOD OF INVESTIGATION:

Contact was made with Captain John Drummond, Custody Division, and copies of the following policies were requested: Use of Force, Inmate Grievances, Confidential Correspondence, Complaints, and Shower Procedures.

FINDINGS:

1. The complainant did submit a letter to Captain Drummond detailing inappropriate comments by one of the correctional offices and an Internal Affairs investigation was ordered.
2. The correctional officer involved was transferred from the Jail Core.
3. The Internal Investigation was conducted, including interviews with the complaining inmate, subject officer, and witness inmates. Based on the transcripts of the interviews, Captain Drummond determined that the allegations were "unfounded", meaning no "Police Procedure, or Law" was violated.
4. Captain Drummond indicated that the involved officer could have done things differently and that steps have been taken to improve his "inter-personal skills" when dealing with female inmates.
